GENEXTECH SOLUTIONS LLC ("GENEXTECH", "we", "us") respects and is committed to protecting the personal data of our customers, partners, and website visitors.

This Policy explains how we collect, use, store, share, and protect personal data when you: (i) visit genextech-solutions.com; (ii) submit a contact form or newsletter sign-up on our website; (iii) provide information through GENEXTECH's advertising Lead Forms on LinkedIn, Facebook/Meta, Google, or similar platforms; (iv) contact us via email, phone, or social media.

This Policy is drafted in accordance with Vietnamese law on personal data protection, including Personal Data Protection Law No. 91/2025/QH15 and Decree 356/2025/NĐ-CP.

1. Personal data we collect

a) Data you actively provide: full name; email address; phone number; company name or company website; job title or field of work; the content of your inquiry or message to us.

b) Data from advertising Lead Forms: when you submit a Lead Form on LinkedIn, Meta, or another platform, we receive the fields you confirm to submit — typically name, email, phone, company, job title, and the service you're interested in. These platforms may pre-fill fields from your profile; you review and decide before submitting.

c) Technical data when you visit our website: IP address, browser and device type, operating system, pages visited, time and source of visit — collected via cookies and analytics tools (see Section 8).

We only collect basic personal data necessary to respond to and advise business inquiries; we do not intentionally collect sensitive personal data. Please do not submit sensitive data through our forms.

2. Purposes of processing

We process personal data to:

• Respond to your requests for consultation, quotation, or partnership;

• Advise on GENEXTECH's Cloud (AWS, Azure, Google Cloud), DevOps, Generative AI, CRM, security, and automation services;

• Send newsletters, materials, event or program information when you subscribe or consent to receive them;

• Manage and maintain relationships with customers and partners;

• Measure the effectiveness of marketing campaigns; improve our website, content, and services;

• Fulfill legal, security, audit, fraud-prevention obligations, and resolve disputes when necessary.

We only process data for the purposes disclosed above. If a new purpose arises, we will notify you and obtain your consent before processing.

3. Legal basis for processing

We process personal data on the basis of your consent — expressed by actively completing and submitting a form (on our website or an advertising Lead Form), subscribing to our newsletter, or otherwise confirming consent in a verifiable manner. Silence or non-response is not considered consent.

We may also process data without consent in cases permitted by Vietnamese personal data protection law — for example, to perform an agreement or contract between you and GENEXTECH, or at the lawful request of a competent state authority.

You may withdraw your consent at any time (see Section 6). Withdrawal does not affect the lawfulness of processing carried out before the withdrawal.

4. Sharing data with third parties

GENEXTECH does not sell, trade, or rent personal data under any circumstances.

Data may be shared, to the extent necessary, with:

• GENEXTECH internal staff or departments directly handling your request;

• Service providers supporting our operations: website hosting, email, CRM, cloud storage, analytics, and marketing tools — these providers only process data under our instructions and are bound by corresponding confidentiality obligations;

• The advertising platform where you submitted a Lead Form (e.g., LinkedIn, Meta) — these platforms also process data under their own privacy policies. LinkedIn specifically retains Lead Form data on its systems for approximately 90 days before deletion;

• Competent state authorities when required by law, or when necessary to protect GENEXTECH's lawful rights and interests.

5. Processing period, retention, and data protection

Processing begins from the moment you submit information to us. Retention periods are as follows:

• Contact/lead data: during active correspondence and up to 24 months from the last interaction if no partnership materializes;

• Contracted customer data: for the contract term plus any retention obligations under accounting, tax, and commercial law;

• Newsletter subscription data: until you unsubscribe or withdraw consent.

After these periods, data will be deleted or de-identified.

We apply appropriate technical and organizational measures (access control, encrypted transmission channels, internal role-based permissions) to protect data against unauthorized access, loss, misuse, disclosure, or alteration.

Inherent risk: no electronic transmission or storage method is completely secure; risks may include unauthorized access or data breaches resulting from cyberattacks. In the event of an incident affecting your personal data, we will notify you and the relevant authorities as required by law.

6. Your rights over your personal data

Under the Personal Data Protection Law, you have the right to:

• Be informed about how your personal data is processed;

• Consent or refuse consent to processing; withdraw previously given consent;

• View, correct, or request correction of your personal data;

• Request provision, deletion, or restriction of processing; object to processing;

• File complaints, denunciations, lawsuits, and claim damages as provided by law;

• Request the application of measures to protect your personal data as provided by law.

To exercise these rights, please contact us using the details in Section 12. We may need to verify your identity before processing your request and will respond within the statutory timeframe.

7. Email marketing and promotional information

If you subscribe to our newsletter or consent to receive information via a form, GENEXTECH may send you content about our solutions, events, and expert materials via email, at a reasonable frequency (typically no more than 4 emails per month).

You may opt out at any time via the unsubscribe link in our emails or by sending a request to the address in Section 12. We will stop sending promotional content promptly upon receiving a valid request.

8. Cookies and tracking technologies

Our website uses cookies and similar technologies to remember user preferences, analyze traffic, and measure advertising effectiveness. Tools currently in use may include: Google Analytics, LinkedIn Insight Tag. These tools may record your browsing behavior according to the respective provider's policy.

You can configure your browser to refuse or delete cookies; some website functions may not work fully if cookies are disabled.

9. Links to third-party websites or platforms

Our website may contain links to third-party websites, social media platforms, or services. We do not control and are not responsible for the content, privacy policies, or data handling practices of such third parties. We recommend reviewing each platform's privacy policy before providing personal data.

10. Cross-border data transfer

Some of our service providers (hosting, email, CRM, analytics, advertising platforms, cloud infrastructure) operate servers located outside Vietnam; your data may therefore be stored or processed abroad. When cross-border transfer of personal data occurs, GENEXTECH carries out the impact assessment and protective measures required under Vietnamese personal data protection law.

11. Children's personal data

GENEXTECH's services and website are directed at business customers and professional users; we do not intentionally collect children's personal data. If you believe a child has provided personal data to us without appropriate parental or guardian consent, please contact us so we can review and delete that data.
